Terms of Service
These terms govern your use of Sunny Drinks (“the app”), operated by Robert Kump (“we”). By using the app you agree to them. If you don’t agree, don’t use the app. Apple’s standard Licensed Application End User License Agreement also applies to the app.
What the app does
The app estimates whether bar patios are in sun or shade at a time you choose, using the sun’s position, building footprints and heights, and weather information. It is an information tool. We don’t sell alcohol, take reservations, or operate any venue.
Estimates, not guarantees
Sun and shade results are estimates. They don’t account for trees, awnings, umbrellas, temporary structures, construction, or errors in building and patio data. Patio locations, hours, seasons, and whether a venue serves alcohol can be wrong or out of date. Weather comes from Apple Weather and may differ from conditions on site. Confirm with the venue before you travel, and don’t rely on the app for anything where accuracy matters, such as health or safety.
Drink responsibly
You must be of legal drinking age where you are to purchase alcohol. Please drink responsibly, don’t drink and drive, and follow local laws and venue rules.
Optional account
An account is optional: the app works fully without one, and an account only syncs your favorite patios across devices. If you create one, give accurate sign-in details and keep your password and devices secure; you are responsible for activity on your account. Message and data rates from your carrier may apply to sign-in codes sent by text. We may suspend or delete accounts used to abuse the service. You can delete your account at any time in Preferences > Account > Delete Account. Syncing is provided as is, and we may change or discontinue it; your favorites always stay on your device. Our Privacy Policy explains what an account stores.
Acceptable use
Don’t misuse the app: don’t copy or scrape the bundled data to build a competing dataset except as the original data licenses allow, don’t reverse engineer the app except as law permits, and don’t submit unlawful, false, or abusive suggestions or reports.
Third-party data and services
The app includes data from OpenStreetMap contributors and Overture Maps (licensed under the Open Database License) and city open-data portals, and uses Apple Maps and Apple Weather. Those sources keep their own licenses and terms. Credits are in the app’s About screen.
Intellectual property
The app, its design, and our processing of the data are owned by us or our licensors, except for third-party data under its own license. We grant you a personal, non-exclusive, non-transferable license to use the app on devices you own or control.
Suggestions and reports
If you send us suggestions, corrections, or reports, you give us permission to use them to improve the app and its data without payment or credit.
Disclaimer
The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the fullest extent the law allows, we aren’t liable for indirect, incidental, special, or consequential damages, or for any loss from relying on the app, including a patio that turns out to be shaded, closed, or different from what the app showed. Our total liability for any claim is limited to the amount you paid for the app, which is zero for the free version. Some places don’t allow these limits, so they may not apply to you.
Changes and termination
We may change the app or these terms. If we change the terms, we’ll update the date above, and continued use means you accept the changes. You can stop using the app at any time by deleting it.
Governing law
These terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules, except where your local consumer law says otherwise.
